Birth Trauma
Birth traumas are injuries that occur to a baby during the labour and delivery process and can be the result of substandard obstetrical care. We have extensive experience representing families whose child has brain damage, cerebral palsy, and/or brachial plexus injuries, amongst others, as a result of substandard obstetrical care.
Class Action
Class action lawsuits are cases in which a group of individuals have claims in common against the same individuals or entities. Class actions can arise against individuals, such as doctors, or against institutions, such as hospitals and long-term care homes. Please note that we only accept class actions involving medical malpractice claims.
Emergency Department Care
These cases arise when a patient seeking emergency medical help suffers even greater harm as a result of substandard care. Examples of emergency room negligence include errors in triage, failure to order standard diagnostic tests, delaying treatment, failure to consult a specialist, and/or a failure to properly monitor a patient.
Failure to Diagnose
These cases arise from injuries that would have been avoided by an earlier diagnosis. Failing to make a correct diagnosis can lead to a lawsuit when the health provider fails to adhere to standard diagnostic approaches, fails to order correct medical tests, fails to rule out more severe possibilities, and/or fails to properly interpret imaging or test results.
Hospital Negligence
These cases involve injuries that occur due to failures of hospital staff, systems, or equipment. Common causes of hospital negligence include substandard nursing care, patient falls, unsafe or unclean environments, and/or improperly functioning medical equipment.
Maternal Complications
These cases involve injuries to pregnant women or new mothers as a result of negligent treatment at anytime during pregnancy or the period immediately after delivery. Common complications include mismanaged pre-eclampsia, gestational diabetes, maternal infection, postpartum hemorrhage, or cases in which the mother was not informed of the pregnancy in reasonable time resulting in an unplanned delivery.
Medication Errors
These cases involve preventable injuries that arise from improper medication use while the medication is under the control of the health provider. Common causes of medication error lawsuits include dispensing an incorrect medication, miscalculating a dose, and/or failing to identify drug interactions and contraindications.
Midwifery and Doula Care
These cases arise from the improper management of the mother’s pregnancy by a midwife or doula. Examples of improper management include a failure to monitor, a failure to diagnose the mother or infant, and/or a failure to transfer care to a physician when necessary.
Neonatal Care
These cases arise in infants who have suffered avoidable injuries while in the neonatal intensive care unit (NICU). Common types of negligence in the NICU include newborn resuscitation errors, airway management errors, failure to properly treat hypoglycemia, and/or improper management of newborn infection, amongst others.
Pediatric Care
These cases occur when a child seeks medical attention but acquires an avoidable permanent injury because of medical negligence. Substandard pediatric care can be the result of a failure to properly diagnose, failure to properly monitor a child’s condition, and/or a failure to provide proper treatment, amongst others.
Radiological Error
These cases arise when a radiologist misreads medical imaging which results in an injury to the patient. Common causes of radiologic error include the failure to observe clinically relevant findings visible in the available imaging and/or the failure to properly report important findings to the relevant health professional.
Surgical Error
These cases involve injuries that have been caused by a preventable error during surgery. Surgical errors can include nerve injury, anesthesia error, leaving surgical equipment inside the patient, and/or performing incisions at incorrect or unauthorized locations.
