Brock Medical Malpractice Law PC and Oatley Vigmond LLP have started a class action lawsuit against the owners and operators of Roberta Place Long Term Care Home located on Essa Road in Barrie, Ontario. The class action addresses the January 2021 COVID-19 outbreak at Roberta Place which led to approximately 129 residents contracting COVID and at least 70 deaths.
The proposed class includes residents who lived in the home between January 10, 2020 and February 18, 2021, and were infected with COVID-19. Both surviving and deceased residents are included in the proposed class. Additionally, the parents, siblings, spouses, children, and grandchildren of infected residents are included as members of the proposed class.
The proposed representative plaintiffs in the class action are Marcella Lambie, the sister of Roberta Place resident George Head, and Scott Martin, the son of Roberta Place resident Janet Martin. Mr. Head is a survivor of the outbreak while Ms. Martin passed away during the outbreak.
